“The Great Wampums of Peace”

These laws (wampums) are adopted from the Great Law of Peace of the Mankwa “Iroquois”, our Uncles, as set forth by Deganawida, the Peace Maker. Changes have been made to meet the differences of our Tsalagi Culture. We, of the Chickamauga of the Tsalagi Nation, shall abide by the following Wampums in the governing of our Thirteen (13) Bands and numerous villages, as our Great Chief Taman did before us.

1st WAMPUM

We, the Sakimawak, Chiefs, and Kichikaho’wasak, Clan Mothers of the Chickamauga, the Tsalagi, do plant a Great Tree of Peace amongst ourselves, in the heart and center of our Nation at Wapalanewank, Place of the Eagle. Under the shade of this Tree seats have been made for our Chiefs to keep and watch over the Council Fire of our Confederacy. All matters concerning our People as a whole shall be brought here first, before the Head Chiefs of our Nation.

2nd WAMPUM

From this Great Tree of Peace at the Center of our Nation, twelve (12) roots grow, to all of the directions. All of these roots (Bands) shall join at the center and become as one (1) forevermore. Should any Nation or individual outside these roots adopt these Great Wampums and wish to join with us, they shall discipline their minds and Spirits to obey and honor these Wampums and the wishes of the Council of our Confederacy. Then they will be made welcome to take shelter under the branches of this Tree.

3rd WAMPUM

Thirteen (13) bound Matsheku’na, prater sticks, symbolize our unity. Our power is now one (1) within the Chickamauga, the Wolf People. We have joined ourselves together in one (1) body, heart, mind and spirit, to settle all matters as one. We shall work, counsel and confirm together for the future of the coming generations.

4th WAMPUM

The Chiefs and Clan Mothers of the Chickamauga, Wolf Clan Cherokee, are now unified in a Circle. If a Chief or Clan Mother leaves this Confederacy, then they have lost their title and shall not be recognized as such by our people. Those people who do not honor and follow these Wampums, who wish to do things their own way and who would set themselves apart from this Confederacy, shall loose all birthrights and claims of our Nation and our territories. The leaders of this Confederacy must be firm, so that if a Chief leaves or is cast out of our Circle, we will not weaken our hold, keeping the strength of our people, our Nation together.

5th WAMPUM

Our eyes shall be as an eagle’s, looking far into the distance, and should any danger threaten the Bands and Villages of our Nation, or any of our People, and someone sees the evil approaching, they shall call to the People who have joined under the Great Tree and warn them of the danger. Then the Chiefs shall Counsel together and discuss the danger. When all of the facts have been gathered and discussed and found to be true, then the People shall gather together to resolve the problem, putting their minds together to restore peace and happiness.

6th WAMPUM

There shall be no trouble or fighting between us, and if such does occur we will strive to become as of one body, heart, mind and Spirit, putting this goal foremost in our min ds, for getting our self interests and desires, thinking only of our People as a whole and the future generations ahead.

          Kichisakimd – Head Chief

          Kichitdkwasakimd – Second Head Chief

          Kichimatasakimd – Head Medicine Chief

Council shall be taken with them in all questions and concerns of these WAMPUMS.

13th WAMPUM

The caretaking and watching of the Council Fires of our Nation shall be the responsibility of the Chiefs (Sakimdawak). They are the Fire Keepers of their villages.

The caretaking and watching of the Central Council Fire shall be the responsibility of the Wapalane’wak (Eagle Band) Chiefs. They shall be the Fire Keepers (Tindenutema’tak) of our Nation.

It is the responsibility of the Fire Keepers to keep the Council Fire clear all around, allowing no dust or dirt to be seen near it. A turkey wing (or turkey feather fan) will be provided and used to sweep away any dirt from the Council Fire ( and used to purify with cedar smoke). If you see any crawling creature approach the fire, a stick is provided to you (to each Chief) to remove the creature from near the fire. The dust, dirt and creature represent anything that could bring harm to the People, or that is not for their good or in their best interest. Your fellow Chiefs will support you at all times in this. If unable to reject it alone, you shall call upon the rest of the Chiefs for aid.

Council Procedure

                14th WAMPUM

Councils shall open after sunrise and close before dark, as the light from the Sun allows us to see and think upon things more clearly. No night evil and mischievous Spirits may be about and influence us, turning us away from the Good Mind.

15th WAMPUM

When a Council is held, with the Chiefs and / or Clan Mothers in attendance, a Chief or appointed Speaker, shall open the Council by seeing that the following are attended to:

1.      That a pure fire is lit (preferably with a bow drill, but matches will suffice).

2.      That all who sit in Council are purified with cedar smoke before the opening of the Council Fire. This is to be done using the turkey wing (or feather fan) provided for the Chiefs.

3.      Calling upon the Creator and Spirit Beings to be among those in Council, by burning tobacco in a bowl or in a Pipe and making an offering to the Spirits.

4.      Giving of the Thanksgiving Address.

5.      Greeting (introduction) of Chiefs and Clan Mothers.

When these things have been completed, then a Council shall be declared open and the Chiefs and Clan Mothers will be ready to discuss the matters and concerns of our Nation.

16th WAMPUM

A Chief or a chosen Speaker opens a Council by first asking the Chiefs and Clan Mothers if there is a matter anyone would like to bring before the Council. A Chief or Clan Mother shall first address the matter before the Council. All on the Council shall speak in turn concerning this. The Chief is to see that only one matter is reviewed at a time, and that only this matter is discussed, until such time as each Chief and Clan Mother has finished speaking on the matter before them and have come to a decision.

17th WAMPUM

Properly, only the Chiefs and Clan Mothers are to stand and talk in Council, as they are the Speakers and Voice of the People. However, any person may speak if they ask to address the Council through their Clan Mother or Chief and this request is granted by the Chief. Any person may, at any time, be asked to speak or asked a question by a Chief or Clan Mother, on a matter which comes before the Council.

If a person other than a Chief or Clan Mother wishes to convey an idea or wisdom to the Council, they should do so through their Clan Chief or Clan Mother. Discussion, between each other, or with one’s Clan Chief or Clan Mother, shall be done in a low tone and without disrupting those who are speaking before the Council.

18th WAMPUM

When a matter is in Council, the Chiefs or Clan Mothers, or other person who is to speak, shall stand (if possible) and give their voice. No one else shall be permitted to speak until the one who is speaking is through. To do so is considered unruly behavior and one who shows such disrespect shall be warned but once by the War Chief or Chief. If any person persists in disrespectful or disruptive behavior, it is the duty of the War Chief to ask that person to remove themselves from Council. If they refuse to leave, the War Chief may use physical force, and the other men or warriors shall assist the War Chief in his duty.

19th WAMPUM

A person who speaks in Council, though having the right to speak and none other, shall keep their words to the matter being addressed in Council, and not talk for too long, giving respect to others that they may speak and that time may be had to address other matters. To speak too long is disrespectful. If one Chief decides a speaker is talking far too long, or strays from the matter being addressed, he may stop the speaker.

20th WAMPUM

No one shall argue for or against a matter at any time during Council. Speakers will talk peaceably, giving no offense, insults, or disrespect towards anyone in any way.

21st WAMPUM

No person or foreign Nation who is interested in a matter before the Council of our Nation shall have any voice except to answer questions put to them by Chiefs or Clan Mothers.

22nd WAMPUM

If, at anytime, the People are required to change these Wampums the recommended changes will be put to the Grand Council Chiefs. If they feel the changes are necessary to benefit the People, they will make the changes.

23rd WAMPUM

All decisions, on all matters must be reached in consensus or total agreement by the Clan Mothers and Chiefs. If not, then a matter is put aside until a later time. A particular matter may be brought to Council three (3) times. On the third time if a decision cannot be agreed upon the matter is to be buried in the Earth.

24th WAMPUM

All who sit in Council shall strive to be of one body, heart, mind and Spirit. The Chiefs and Clan Mothers of our Nation shall put aside all angry and selfish thoughts; strive always to be of Good Mind, and think only of the good of the People and the future generations ahead.

Kuthake Achimosink “The Band Council”

25th WAMPUM

When a problem or situation occurs that would affect a Band as a whole, a Band Council shall be called forth and opened.

26th WAMPUM

When a matter is thought to require a Band Council, such may be opened by the Head Chiefs of the Central Council Fire, or the matter or concern may be brought before the Head Chiefs by a Chief or Clan Mother by messenger or message. The Head Chiefs shall then consider the matter and they shall notify the Chief or Clan Mother who requested such a Council of their decision. If the matter is found to be worthy of a Band Council, such shall be called forth and opened.

27th WAMPUM

A Band Council shall consist of the Head Village Chiefs or the Mothers of a Village of a Band. Each shall be purified by the Head Chief. They shall first listen to the Chiefs, Clan Mothers, and Wise Counselors of their respective Villages before entering into a Band Council.

28th WAMPUM

The Head Chiefs, at their discretion, may open a Band Council and approach one Village at a time, gaining the input of each Village and passing their voices onto the other Villages.

29th WAMPUM

A Band shall consist of no more than four (4) Villages.

30th WAMPUM

If a disciple arises between Villages or Bands, or Chiefs, or Clan Mothers, that cannot be resolved; or if there is no Peace Chief to resolve the situation; it is to be referred to the Head Chiefs of the Central Council Fire, and their decision shall be final, and is to be accepted and respected.

KICHIMOSINA’KAN “The Grand Council”

32nd WAMPUM

A Grand Council is called for when a matter arises which shall affect the Nation as a whole. If the Head Chiefs, Chiefs or Clan Mothers see a matter which they think would require a Grand Council to be called, they shall bring it before the Head Chiefs of the Grand Council Fire by messenger or message. Then the Head Chiefs shall join together to consider the matter. If they find that it is a worthy matter, and one that concerns the Nation as a whole, they shall then call forth and open a Grand Council.

33rd WAMPUM

The Head Chiefs shall call forth a Grand Council, Kichimosina’kan, by sending a messenger or message to each Village Chief of each Band (Kuthaka), and setting the matter before them; the Village Chiefs will then make their decision, and return them to the Nation Head Chiefs.

34th WAMPUM

If the Head Chiefs hold a decision not to be in the best interest or benefit to the People, they will refer it back to those Village Chiefs who made the decision, pointing out the areas of difficulty. The Village Chiefs shall then reconsider, and put forth their decision to the Head Chiefs.

35th WAMPUM

A matter put to a Grand Council will be acted upon or put into effect only if a consensus agreement can be reached between the Head Chiefs and Village Chiefs.

36th WAMPUM

If the Head Chiefs should be against a matter, or if there is a disagreement among them, the matter brought before the Grand Council cannot be passed.

37th WAMPUM

If the Head Chiefs cannot meet together, a decision on a matter cannot be made until all are heard from.

38th WAMPUM

When a matter is put before the Head Chiefs, Kichisakimd shall consult the other Head Chiefs. Kichitakwasakimd (2nd Chief) will sit back and listen to all that is discussed. When the other Chiefs have reached a decision, Kichisakimd then turns the matter over to Kichitakwasakimd, who shall decide on the matter. Without his agreement the other Chiefs have no authority to pass it. Should Kichitakwasakimd (Head 2nd Chief) refuse to agree upon and pass the matter, his reason must have a strong basis for refusal.

**********

39th WAMPUM

The Chiefs and Clan Mothers can construct shell strings or a Wampum Belt of any size or length as documents or records of matters on National affairs. When it is necessary to send a message any distance by messenger or talking leaf, the messenger shall recite, or the talking leaf tell of the contents of the string to the People assembled. When a message is received, the matter shall be discussed and a reply prepared to send back. The People shall have the right to use the Wampum as records of a pledge, contract or agreement answered into by any group. The Wampum binds the agreement as soon as it is given and received on behalf of both parties.

40th WAMPUM

If a Chief or Clan Mother of our Nation neglects, abandons, or refuses to attend a Council, the Council will send the War Chief or a Clan Warrior to them or to their Clan relatives, asking their intentions. If a Chief or Clan Mother has good reason as to why they cannot attend then they should notify the Council well beforehand. If no message is received by Council of the absence of a Chief or Clan Mother, and the War Chief or a Clan Warrior is sent to inquire of absence, they will be asked only once as to why they were not in Council. If the War Chief or Clan Warrior is given no answer then the Chief or Clan Mother will be replaced; from the sons of a Chiefs female relatives or from the female Clan members of a Clan Mother.

41st WAMPUM

If a Chief or Clan Mother commits murder, rape / sexual abuse, or steals, they shall lose their title at once.

42nd WAMPUM

If a Chief or Clan Mother, during their term of office suffer any bodily defect, such as infancy, idiocy, blindness, deafness, ________, ______, ______ _______ behalf in Council. However, in the case of serious matters their defect will not stop them from taking part as a titleholder.

43rd WAMPUM

If a Chief falls (dies), his Clan’s Clan Mother and his female Clan relatives select a new Chief. All must be in agreement on a person selected. People selected are to be brought up and discussed. A Chief’s title rightfully goes to his sister’s son or her nearest male relative, but must have certain qualifications and be decided upon by the fallen Chief’s female Clan relatives. The above also applies if a Chief should lose his title due to actions unbefitting a Chief.

44th WAMPUM

If a Clan Mother falls (dies) or loses her title, her female Clan relatives shall select a new Clan Mother. All must be in agreement on the person selected, but they must meet the qualifications presented in the WAMPUMS.

45th WAMPUM

One who is to be Chief or Clan Mother must be honest. They must be of good heart and think good thoughts. They must think only of the People and do what is right for them; they must be free of a preoccupation with their ego and selfish desires. One who would hold such a position of Title must be one who has never expressed a desire to be Chief, as those who do so would be most likely to abuse their position. A man must not be a womanizer, or a woman flirtatious.

46th WAMPUM

If a Chief or Clan Mother decides to resign and relinquish their title, they shall inform the Council. If they select someone to take their place, the Council will accept their resignation and the selection to replace them. The replacement will not be given the Title until the matter is approved by the female relatives of the one to which such Title is to be given. If the female Clan relatives of the person who wishes to resign refuse to accept the resignation, they must keep their Title and fulfill their duties.

47th WAMPUM

The Chiefs and Clan Mothers of our Nation shall be advisors and speakers for the People. They shall serve for life, or as long as they are able to effectively. The thickness of their skins shall be seven (&) spans. This will be proof of their ability to disregard words that might be said against them or any wrong against them. Their hearts shall be filled with Peace and Goodwill. Their Spirits want for the good of their People. They will endure long suffering in the carrying out of their duties, and firmness will be handed out with kindness. The Spirits of anger and fury shall not find a place in them, and in everything they say and do, they will think only of the People and not of themselves, thinking ahead not only of the present, but also of the generations of unborn yet to come.

48th WAMPUM

Chiefs and Clan Mothers must be honest in all things. They must not idle or gossip, but always speak and judge from facts, and know only truth in their hearts and minds. They must be possessed of those honorable qualities that make true leaders, and they shall serve as good examples to the People. It shall be a serious wrong for anyone to lead a Chief into trivial affairs, for the People must ever hold their Chiefs in high esteem out of respect to their honorable positions.

49th WAMPUM

The Chiefs and Clan Mothers of new Villages shall be nominated by the People. Such nominations shall be sent to the Head Chiefs of the Central Council Fire, who shall decide if the person nominated will receive such Title or not. If the Head Chiefs decide upon a Chief or Clan Mother they shall then put the position before the person who was nominated and await their answer.

50th WAMPUM

The following shall be the duties of the Chiefs and Clan Mothers of the Nation, to act as teachers and guides for their People, and to remind them of the Creator’s will and words. They will be active in the Ceremonies and assist the Faith Keepers in the Spiritual teachings and traditions.

Lapa’chik “Wise Men or Councilors”

51st WAMPUM

If a man of the Kinkweahumu’wak assists or shows a special ability in the affairs of the Nation, and he proves himself wise and honest, the Sakimdwak (Chiefs) and Clan Mothers may agree to let him sit among them and have a voice. When he sits in Council he will be known as Lapa’chik. Should he do anything against the WAMPUMS no one has the right to dispose him from his seat, but everyone will be deaf to his words. Should he step down from his seat no one has the right to stop him, and he will not have the authority to appoint a successor to replace him. Should a Lapa’chik die or resign, there will be no successor to him.

Duties of Clan Warriors (men with no titles)

52nd WAMPUM

Clan Warriors are selected by Clan Mothers for their ability to express the concerns of his Clan. The men selected are the best orators of the Clan and accompany the Clan Mother when she must meet with the Chiefs. The Clan Warriors then speak to the Chief as a representative of his Clan Mother and Clan.

53rd WAMPUM

There will be one Clan Warrior representing each Clan in each Village. The duties of a Clan Warrior are to carry messages for their Chiefs and Clan Mothers, and to take up weapons in case of war or emergency. They shall not participate in Councils. However, they will watch the progress of the Council and if they see a Chief take a course that is not in the best interests of the People, he will notify the Clan Mothers. The women, through their Clan Warriors shall warn the erring Chief in an open Council. After these warnings the Clan Warrior acting upon the orders of the Clan Mothers shall discharge the Chief and shall install another chosen by the Clan Mothers to take his place.  When it is necessary, a Chief can perform the Ceremony of conferring titles. The People will give all messages to the Clan Warriors of their Clan / Village to pass on to the Chiefs and Clan Mothers. It shall always be their duty to place the cases, questions and propositions of the People, concerning the Nation, to the Council.

54th WAMPUM

If a Clan Warrior acts against these WAMPUMS, he may be removed by his female Clan relatives or Chiefs. The women or Chiefs may act independently or together on this. The women titleholders will then choose another to replace him.

55th WAMPUM

In the case of death of a Clan Warrior another shall be placed in his position by the ceremony of conferring titles and at the same time by the Council.

Removal of the Chiefs or Clan Mothers

56th WAMPUM

The Clan Mothers can remove a Chief. If a Chief is guilty of forcing a woman (rape), child abuse, drunkenness, drug abuse, stealing or murder, or acts of violence towards others, the Chief will be instantly removed without forewarning.

57th WAMPUM

If a Chief shows signs of losing the Good Mind, his Clan Mother talks to him. She must give him three (3) warnings. Then, she, with the consent of the Clan, can remove him.

58th WAMPUM

If a Clan Mother strays from the right path of the Good Mind, the Clan can remove her also.

59th WAMPUM

A Chief may not be a member of a Council of any other Nation, or involved in the governing body of any other organization, etc. Should any Chief try to establish an independent authority other than that of these WAMPUMS, they shall first be warned by their female Clan relatives. If they do not heed the warning, a second warning will be given by their warrior relatives. Should they disregard this, a third and final warning will be given by the Chiefs of the Nation to which the Chief belongs and if they still refuse, the War Chief shall dismiss them and another shall be chosen by the female Clan relatives of the disposed Chief.

60th WAMPUM

When the Chiefs are in error by not acting in the best interests of the People, then the men or women or both together shall bring the matter up at Council.

If a Chief disregards the third warning from his women Clan relatives for an error or wrongdoing, the women shall Council with the Clan Warriors or War Chief. From among the warriors, one shall be chosen to accompany the Clan Mother to speak on behalf of the Clan to the Chief saying:

“So you disregarded the warnings of your female relatives. You have flung the warning over your shoulder to put them behind you. Take notice of the brightness of the sun and sun’s light, I take away your title and remove the sacred emblem of your title of Chief. I take away from your head the deer’s antlers which was the symbol of your noble position. I now dehorn you and return your title to your women relatives to hold.”

The speaker again addresses the Clan Mothers saying:

“Mothers, I have dehorned your Chief and return the title and emblem of that title to you, take and hold them.”

The speaker then addresses the dehorned Chief again saying:

“I have now taken away your status of Chief. The Creator does not condone wrong doings, so he will not come to your aid on the course of destruction which you have chosen. You will never be returned to your former title.”

The speaker then addresses the Council of the Village to which the dehorned Chief belonged.

“Before you, the Chiefs and Clan Mothers, I have taken the deer antlers, symbol of position and greatness.”

The Council shall have no choice but to sanction the removal of the Chief.

Conferring a Title (Chief, Head Mother and Vice Chief)

61st WAMPUM
